Terms of Service.

Effective:

1. Acceptance

  • By creating an account or using the Persona platform you agree to these Terms.
  • If you are using Persona on behalf of an organization, you represent that you have authority to bind that organization.

2. The service

  • Persona generates and runs configurable AI personas (Soul → Self → Mask → Surface).
  • Service availability is governed by the SLA for your subscription tier; Free is best-effort, paid tiers have explicit uptime commitments.

3. Acceptable use

  • No illegal content, no celebrity / political-figure impersonation, no PII without lawful basis, no scraping of other tenants.
  • No use of generated personas to deceive a user into thinking they are interacting with a real human, where such deception would be misleading or unlawful.
  • Moderation pipeline (ADR 0010) decisions are final; appeals via support@moonborn.co.

4. Your content

  • You retain ownership of personas you create and prompts you submit.
  • You grant Persona a worldwide, non-exclusive license to process Your Content solely to provide the Service.
  • You are responsible for ensuring you have the right to submit content (no copyright infringement, no defamation, etc.).

5. Fees & billing

  • Paid plans are billed monthly or annually in advance via Stripe.
  • Usage above plan limits is metered (tokens, characters, storage); current rates are on /pricing.
  • Late payment may result in service suspension; refunds are pro-rated for unused time after cancellation.

6. Termination

  • You may cancel at any time from the workspace settings.
  • We may suspend or terminate accounts for material breach, payment failure, or moderation violations after written notice (except for security incidents requiring immediate action).
  • On termination we retain audit logs for the legal retention period and purge other data within 30 days.

7. Warranties & liability

  • Persona is provided "as is" without warranties beyond those required by applicable law.
  • To the maximum extent permitted, our aggregate liability is limited to the fees you paid in the preceding 12 months.
  • Nothing limits liability that cannot be limited under applicable law (e.g. willful misconduct, death/personal injury).

8. Changes

  • We may amend these Terms; material changes require 30 days notice via email or in-product banner.
  • Continued use after the effective date constitutes acceptance.

9. Governing law

  • These Terms are governed by the laws of the jurisdiction where Persona is incorporated, without regard to conflict-of-laws principles.
  • Disputes are resolved in the courts of that jurisdiction unless prohibited by law.
